Trafficking in persons has generated increasing global attention in recent decades, largely due to the development of international frameworks, pressure from fundamental feminist and abolitionist groups, and as a reaction to increased migration for labour. International policies on trafficking frequently contain vague or ambiguous language, which can cause harm to sex workers in a number of ways.

It examines the impact of criminalisation at three distinct phases: the surveillance and policing of sex workers prior to arrest; arrest and formal involvement of the criminal justice system; and release and return to the community.

This resource is a Community Guide to the Policy Brief on the Impact of Criminalisation on Sex Workers’ Vulnerability to HIV and Violence. This guide summarises how criminalisation increases sex workers’ vulnerability to violence and HIV, and makes a series of recommendations towards the full decriminalisation of sex work as an integral step to improving the lives of sex workers. The Impact of Criminalisation on Sex Workers’ Vulnerability to HIV and Violence

This policy brief examines the impact of laws that criminalise sex work, informed by NSWP members’ submissions to an e-consultation. It examines the impact of criminalisation at three distinct phases: the surveillance and policing of sex workers prior to arrest; arrest and formal involvement of the criminal justice system; and release and return to the community. The paper covers various areas of law and law enforcement practices that disproportionately impact sex workers, including immigration laws, policing of public spaces, anti-LGBTQ laws, HIV criminalisation and religious codes.

Report Highlights Condoms being used as Evidence of Sex Work in China

A new report by Asia Catalyst has brought attention to the impact of laws and policing on sex workers in China. Released on the 25th of July, The Condom Quandary: A Survey of the Impact of Law Enforcement Practices on Effective HIV Prevention among Male, Female, and Transgender Sex Workers in China highlights the severe and widespread impact of using condoms as evidence of sex work on sex workers. Drawing on the experiences of the 517 sex workers involved in the research, the report urges that sex work be decriminalised and that sex workers be properly consulted and recognised as key stakeholders in laws and policies concerning sex workers.

The Condom Quandary

Asia Catalyst has published their report The Condom Quandary: A Study of the Impact of Law Enforcement Practices on Effective HIV Prevention among Male, Female, and Transgender Sex Workers in China. Asia Catalyst conducted 74 in-depth interviews with male, female, and transgender sex workers, 18 interviews with key informants, and 517 responses to a survey questionnaire. The research was conducted in three major Chinese cities. The report found that using condoms as evidence of sex work violates the human rights of sex workers.

Decriminalisation of Sex Work in Kenya

This policy brief on the Decriminalisation of Sex Work in Kenya was written in collaborartion with the University of Amsterdam and NSWP member HOYMAS and KESWA. This policy brief argues that sex workers have the same rights as other citizens in Kenya as outlined in the Kenyan Constitution. The brief describes key instances in which the rights of sex workers as defined by the Constitution are violated in Kenya.

Police Scotland Dropped Brothel-Keeping Charges in Edinburgh

In the 1980s, in response to rising HIV infections, Edinburgh City Council developed a licensed brothel system giving “saunas” public entertainment licenses knowing that sex was being sold on the premises. The local police force, Lothian and Borders Police, supported this system and would perform annual inspections on the saunas and support the renewal of their licenses.
