UN Special Rapporteur Visits West Papua

In the wake of several human rights officials being denied entry to West Papua, The UN Special Rapporteur for Health, Dainius Puras’, officially visited West Papua last week. Human Rights Watch notes, “Indigenous sex workers in West Papua are being impacted by a HIV epidemic and lack of adequate healthcare amidst wider systematic denials of human rights and violence perpetrated by the Indonesian military and mining companies.”

HIV/AIDS (Prevention and Control) Bill introduced in India

Key affected communities in India have expressed disappointment following the introduction of the “HIV/AIDS (Prevention and Control) Bill,” which passed through the Rajya Sabha on 21 March. Community members have spoken out saying it allows governments to escape their obligation to provide complete treatment to people living with HIV. Article 21 [Right to Life] of the Indian Constitution was previously used to hold the government accountable and advocate for rights to life saving treatment. However, a clause in the new law means that government can argue that their commitment is to provide treatment ‘as far as possible.’

Malawi High Court Rules Use of Rogue and Vagabond Law Unconstitutional

On 28 December 2016, 39 sex workers were arrested under the Rogue and Vagabond offence in the Malawian criminal code. This offence is often used to target street-based sex workers, drug users, vendors, and homeless people.

Section 184(1) (c) of the Penal Code provides that, “every person found in or upon or near any premises of any road or highway or any place adjacent thereto or in any public place at such time and under such circumstances as to lead to the conclusion that such person is there for an illegal or disorderly purpose, is deemed a rogue and vagabond.”

The NSWP Global Fund Quarterly Update includes information about the most recent topics being discussed and addressed within the Global Fund. This update is part of the Robert Carr Civil Society Networks Fund grant to provide Global Fund workshops in collaboration with NSWP members. In 2016, there will be a total of 4 updates.

Report Highlights Condoms being used as Evidence of Sex Work in China

A new report by Asia Catalyst has brought attention to the impact of laws and policing on sex workers in China. Released on the 25th of July, The Condom Quandary: A Survey of the Impact of Law Enforcement Practices on Effective HIV Prevention among Male, Female, and Transgender Sex Workers in China highlights the severe and widespread impact of using condoms as evidence of sex work on sex workers. Drawing on the experiences of the 517 sex workers involved in the research, the report urges that sex work be decriminalised and that sex workers be properly consulted and recognised as key stakeholders in laws and policies concerning sex workers.

The Condom Quandary

Asia Catalyst has published their report The Condom Quandary: A Study of the Impact of Law Enforcement Practices on Effective HIV Prevention among Male, Female, and Transgender Sex Workers in China. Asia Catalyst conducted 74 in-depth interviews with male, female, and transgender sex workers, 18 interviews with key informants, and 517 responses to a survey questionnaire. The research was conducted in three major Chinese cities. The report found that using condoms as evidence of sex work violates the human rights of sex workers.

Speaking Out: Personal Testimonies of Rights Violations Experienced by Sex Workers in Kenya

The National Empowerment Network for Persons Living with HIV and AIDS in Kenya (NEPHAK), the Kenya Sex Workers Alliance (KESWA), the Bar Hostess Empowerment and Support Programme (BHESP) and the Global Network of People Living with HIV (GNP+) have published their report Speaking Out: Personal Testimonies of Rights Violations Experienced by Sex Workers in Kenya. This report focuses on human rights violations among female sex workers living with HIV. It is based on a literature review and interviews conducted in May 2014 among 30 sex workers living with HIV in six counties: Nairobi, Mombasa, Kiambu, Machakos, Kisumu, and Busia.
