This is NSWP's response to the consultation carried out in Scotland (UK) on the Criminalisation of the Purchase of Sex.  

This proposal would make it illegal to purchase sex in Scotland. Rhoda Grant MSP, who carried out the consultation, believes that ‘prostitution in Scotland is a form of sexual violence against women and sexual exploitation.’  She believes that ‘prostitution is inherently harmful and dehumanising’ and that ‘the majority of those who are involved in prostitution are unwilling participants.’

The Law and Sexworker Health (LASH) team at the Kirby Institute, University of New South Wales were funded by the NSW Ministry of Health to better inform policy considerations, and the National Health and Medical Research Council to investigate if the various approaches across Australian jurisdictions were associated with different health and welfare outcomes for sex workers.

In 1999, the Swedish government embarked on an experiment in social engineering to end men’s practice of purchasing commercial sexual services. The government enacted a new law criminalising the purchase (but not the sale) of sex (Swedish Penal Code). It hoped that the fear of arrest and increased public stigma would convince men to change their sexual behaviour. The government also hoped that the law would force the estimated 1,850 to 3,000 women who sold sex in Sweden at that time to find another line of work.

The criminalisation of sex workers’ clients is often claimed to be part of a new legal framework to eradicate sex work and trafficking by ‘ending demand’. In 1999, Sweden criminalised sex workers’ clients and maintained the criminalisation of third parties such as brothel-owners, managers, security and support staff. The individual selling of sex remained legal. This model is frequently referred to as the ‘Swedish’, ‘Nordic’ or ‘End Demand’ model. There is great pressure in many countries to advance such legal and policy measures. The damaging consequences of this model on sex workers’ health, rights and living conditions are rarely discussed.

This summary, written under the aegis of the Center for Advocacy on Stigma and Marginalisation (CASAM), presents the preliminary results of the first pan-India survey on sex workers. These preliminary findings have been developed for an event in Mumbai on 30 April 2011. The authors appreciate the opportunity to discuss their research with an audience of critical stakeholders. A report which provides their final analysis and data relating to male, trans sex workers, sexuality, stigma and discrimination as well as the 0.5% of 15-17 year olds in this sample will be published later in the year. In the spring issue of Soundings the author compares lived experience to the representations of trafficking presented by major media and government agencies. The evidence presented is a deconstruction the way that the discourse on sex work and trafficking is shaped.

UNAIDS called a meeting at the Barcelona Aids Conference in July 2002 of program planners, researchers, field workers and activists to begin discussing its work on HIV care and prevention among sex workers and clients. For the NSWP this was an important opportunity to ensure that UNAIDS is aware of the NSWP's concerns about programs that sex workers see as ineffective and/or as contributing to the abuse of sex workers. The meeting was preceded by NSWP demonstrations that drew attention to the negative impact on sex workers' human rights of anti-trafficking and public health measures such as mandatory registration and examination of sex workers that are increasingly being promoted as effective approaches to HIV prevention.

Dear Editor:

Donna Hughes (May 1, 2003, Accommodation or Abolition? Solutions to the problem of sexual trafficking and slavery) grossly misrepresents the international Network of Sex Work Projects (NSWP). Her assertions are risible. The NSWP actively works against trafficking in persons, especially children, and lobbied for the passage of the Victims of Trafficking and Violence Protection Act in 2001. The NSWP also works against the violation of civil liberties in the so-called 100% Condom Use Policy programmes, which are dangerously coercive and include forced physical examinations in unsterile and disease-promoting conditions.

Recent changes to HIV funding in the US (HR 1298)

The US Senate approved a new international HIV/AIDS funding bill for approximately $15 billion on Thursday May 15, 2003 (Senate Resolution HR 1298, United States Leadership Against HIV/AIDS, Tuberculosis, and Malaria Act of 2003). The Senate Bill is almost identical to its predecessor in the US House of Representatives and passed through the Senate unusually quickly, preventing debate about the content of the initiative that will triple HIV funding from the US to projects worldwide.

On May 21, the US House gave the final congressional approval to a bill that provides funding for a five-year US$15bn plan to fight HIV/Aids around the world. The bill now proceeds to President Bush for his signature. It is expected that he will urge other states at the G8 meeting early next month to follow the US lead in committing significant funds to fighting HIV/AIDS.

Fostering Enabling Legal and Policy Environments to Protect the Health and Rights of Sex Workers

Johannesburg, South Africa, June 22-24, 2006

Organised and sponsored by the Sexual Health and Rights Project (SHARP) and Law and Health Initiative (LAHI) of Open Society Institute (OSI), this meeting brought together sex workers, service providers, human rights advocates, researchers and others to discuss how legal and regulatory environments affect sex workers' health and human rights.

After premature closures in 2004 of biomedical human immunodeficiency virus (HIV) prevention trials involving sex workers in Africa and Asia, the Joint United Nations Programme on HIV/AIDS (UNAIDS) and Global Advocacy for HIV Prevention (AVAC) undertook consultations to establish better participatory guidelines for such trials in order to address ethical concerns. This study investigated sex workers’ knowledge and beliefs about research ethics and good participatory practices (GPP) and the perspectives of sex workers on research participation. A 33-question survey based on criteria identified by UNAIDS and AVAC was translated into three other languages.
